Guest speaker Attorney Dirk Galbraith spoke on the findings of the court
regarding City of Ithaca Ordinance 95-1. He and the Rabinor's used the information
we gave them about the 1981 Law- Uniform Fire Prevention and Building Code.
The Rabinor's alleged that even though the City of Ithaca can approve laws
more stringent than the State of New York, they can't apply them to any
before 1984 without provisions for financial assistance.
This case is now being appealed by the city to Appellate Division 1st
level. There should be a decision before August 1998. Until then the Building
Dept. can not require them. Attorney Galbraith believes the City will again
lose.
Attorney Galbraith also believes there are other building codes which
are also being enforced illegally. The LATC has appointed a committee to
